UK Supreme Court ruling on legal definition of a woman – 16 April 2025

On 16 April 2025, the Supreme Court ruled that the legal definition of a woman within the Equality Act (2010) is based on biological sex. Currently, we are awaiting national guidance about what that will mean for our workforce and the services we provide and will provide further updates when we know more.
We understand that this decision will impact on colleagues and those who use our services in different ways and may be causing confusion and anxiety. We want to be clear that we are committed to providing services and support to our trans and gender diverse colleagues and patients. NHS England have stated that it is currently reviewing guidance on same sex accommodation and as part of this process, will consider and take into account this ruling alongside all other relevant legislation and guidance. Within Nottinghamshire Healthcare, of which the NCTHN is part, this will include discussions with our LGBT+ Staff Network, our recognised trade unions and our patient voice groups.
